FST Media’s Terms & Conditions Attached to Confirmation of Sponsorship/Advertising
These Terms and Conditions apply to all sponsorships or advertising placed with FST Media unless varied in writing and signed by FST Media Pty Ltd and the Sponsor/Advertiser. In these Terms and Conditions the “Sponsor” or “Advertiser” shall include any of its agencies agents, officers, employees, contractors. “FST Media” shall mean FST Media Pty Ltd and shall include any of its agencies agents, officers, employees and contractors.
1.1 Confirmation of Bookings
Confirmations of bookings can only be made by the Sponsor or Advertiser’s authorised signatory.
1.2 Payment Terms
Following receipt of the signed confirmation document, the Sponsor or Advertiser will be invoiced for payment according to the following schedule.
• Events/Digital Bookings:
Full payment is due 28 days from the date of the invoice. If the invoice date is within 28 days of the date of the Event, full payment is due within 1 day of the date of the invoice.
• Roundtable Bookings:
Payment Terms: The invoice is payable prior to the event. Execution and delivery of the above will only commence once the deposit has been paid and a FST Media Roundtable Scoping Form has been completed. The scoping form must be completed a minimum of 8 weeks prior to the Event date. The date of the event cannot be confirmed until both the deposit and the scoping document have been paid/submitted.
• Events and Roundtables
In the event of cancellation or postponement of the Event through no fault of FST Media PTY Ltd refunds will not be given. Furthermore FST Media PTY Ltd will be able to treat itself as wholly or partly released from its obligations to provide the Sponsorship Package and will not be under any liability to the Sponsor for any failure to perform its obligations.
In the event that FST Media PTY Ltd elects to cancel the Event due to circumstances within its control, FST Media PTY Ltd will (in its absolute discretion) either offer the Sponsor an alternative sponsorship package of comparable standard and benefits or a credit of equivalent value towards a future FST Media event, such credit to be valid for one year from the date of issue.
Cancellation by the Sponsor will only be valid if made in writing. If the Sponsor cancels a Sponsorship Package at any time prior to the Event it will still remain liable to pay FST Media PTY Ltd the full amount of the Sponsorship Fee and if it has already paid the Sponsorship Fee it shall not be entitled to a refund.
• Digital Bookings
Written notice of cancellation 45 days prior to the advertising publish date is required. A minimum charge of 25% is due in the event of cancelation irrespective of the date of activity/event or campaign upon signing the booking agreement. If an order is cancelled within 45 days, then the full amount is payable
1.4 Sponsor Responsibilities
It is the full responsibility of the Sponsor to ensure that all deadlines are met in the lead-up to the event to allow for timely preparation. FST Media accepts no responsibility for the consequences of late deliverables.
1.5 Intellectual Property
FST Media will consult the Sponsor for the use of the Sponsor’s logo, intellectual property and marketing material prior to the use of such material.
1.6 Display Stands/ Audio Visual
Sponsors are solely responsible for the organisation, design, and installation/removal and associated costs of their display/promotional stand to ensure it is in keeping with venue space allocations, function area limitations and safety regulations utilised at a FST Media conference. Sponsors are financially responsible for all Audio Visual costs resulting from their requests for specific A/V, communication, computer, lighting and display stand set-up.
1.7 Delivery & Storage of Goods
Sponsors are responsible for any costs relating to the delivery, set up, bump in/out and any associated delivery/storage costs of their event goods.
FST Media cannot accept responsibility for any loss or damage of the Sponsor’s property or their contractors prior to, during or after an event. Accordingly, the Sponsor should make the necessary arrangements to obtain their own insurance. It is also the responsibility of the Sponsor to provide personal insurance cover for their representatives and contractors.
Sponsors are financially liable for any damage to their equipment and property whether through their own negligent action or through the negligent action of their contractors and/or sub-contractors. Sponsors are also financially liable should they or their contractors/subcontractors cause damage to the function venue.
1.10 The following conditions apply to the placing and publication of advertising:
All advertising campaigns accepted by FST Media, will be subject to the following preconditions:
• FST Media shall not be liable for any loss or damage as a result of advertisements being omitted, delayed or altered (irrespective of the cause).
• In respect to all other liabilities arising from the advertisement, the maximum amount which may be claimed against FST Media shall be $50.
Warranties and Indemnities
The Advertiser will accept that no advertising or associated material will be in breach of any law or regulation including (but without limitation to) the laws of negligence, defamation, injurious falsehood, trade practices, fair trading, corporations and business, copyright and trademarks, obscenity and indecency. The advertiser shall indemnify (and keep FST Media indemnified) against any claims, demands, costs, penalties, suits, legal costs (on a solicitor and client basis) and liabilities whether caused by or arising from any act or omission of FST Media.
Placement, Orders and Rates
• FST Media reserves the right to reject any advertising it considers unsuitable.
• Advertisers shall notify FST Media of any error as soon as it is appears and FST Media shall not be liable for recurring errors.
• Advertising is accepted subject to the rules and codes of the Advertising Council of Australia.
• Telephone instructions are taken on condition that the advertiser takes responsibility for any error or misunderstanding arising there from.
• Advertising material must be taken to the location and by the time notified by FST Media to the advertiser.
• Reproduction quality and placement of advertising are at the risk of Advertisers in the event FST Media’s specifications and schedules are not met.
